A man who suffered a brutal attack with a baseball 38 years ago has passed away.

Tschudy was just 26 years old when he was beaten by a Baseball bat in York City in central Pennsylvania, BBC reported. The attack was allegedly a case of mistaken identity. York City Police were not able to identify or capture the assailants and as a result, no charges were ever filed against anyone.

"Due to the inability to identify assailants years ago, there will be no charges," the coroner's office noted. Tschudy's death has been ruled as a homicide because the injuries that ultimately led to death were sustained in an attack.

As no statute of limitations is present in coroner cases, arrests could be made in Tschudy's case if a suspect is ever identified, the NY Post reported. There are no plans for an autopsy, the coroner's report shows.

Tschudy's next of kin have been informed, according to Sky News
