A Florida man was placed under arrest for murder after a woman overdosed from taking fentanyl he provided, authorities said.

The Marin County Sheriff’s Office took Kevin Whitehouse, 41, into custody in connection with the death of Samantha Nell, 28, last winter.

Sheriff’s records obtained by the TC Palm show that around 1 a.m. on January 13, the woman’s daughter told her grandmother, “I could not wake up mommy.”

The grandmother found her daughter, Nell, unresponsive on a bed. Investigators said Nell was in possession of Xanax pills as well as a white powder later determined to be fentanyl.

An autopsy determined Nell died from acute fentanyl intoxication due to substance abuse, an arrest affidavit showed, TC Palm reported.

Investigators launched an investigation into the source of the drugs Nell took at the time of her death and identified Whitehouse as a suspect in the case, according to the arrest affidavit.

Whitehouse recently was arrested on charges that included murder by distributing fentanyl causing death, marking the first time Marin County law enforcement said they have arrested a person accused of causing a fatal overdose.

He was booked into the Martin County jail, where he was being held without bond.
