Marshall was convicted of murder in 2004 in a homicide in Hagerstown and had been out of prison for two years, police said.

He had a warrant out of Pennsylvania for assault for an incident involving Shifflet as well, police stated.

The couple had a child together and child services took custody of the boy, according to police.

Marshall was charged with first-degree murder and other counts related to the Christmas incident, police stated.
