On Feb. 26, the man was arraigned on a count of lewd and lascivious act with a child under the age of 14, The Denver Post reported.

According to the newspaper, the 43-year-old man lived in the same location where his mother ran her day care center, and the facility is also where the alleged sexual abuse occurred.

On March 1, the man, who was granted supervised release from jail, was driving a car in San Jose when 39-year-old Velasquez opened fire on the vehicle, missing who police believe was his intended target and striking the man’s stepfather instead.
